1. Agreement

These Terms & Conditions ("Terms") govern your access to and use of the products, hardware, software, and services (collectively, the "Services") provided by Truck Pilot, LLC ("Truck Pilot", "we", "us", or "our"), an Illinois limited liability company with offices at 1849 Green Bay Rd Ste 109, Highland Park, IL 60035. By using the Services you agree to be bound by these Terms.

2. Eligibility

You must be a U.S.-based motor carrier, owner-operator, or authorized representative thereof, and at least 18 years of age, to use the Services.

3. Account Responsibilities

You are responsible for safeguarding account credentials, all activity that occurs under your account, and ensuring drivers operate ELD hardware in accordance with 49 CFR Part 395 and other applicable FMCSA regulations.

4. Subscription & Billing

Service subscriptions are billed per truck on a monthly basis unless otherwise agreed in writing. Fees are non-refundable except as required by law. Truck Pilot, LLC may modify pricing with 30 days' notice.

5. Hardware

ELD hardware shipped to you remains the property of Truck Pilot, LLC unless purchased outright. You agree to install, operate, and return hardware in accordance with our published instructions.

6. Acceptable Use

You may not reverse engineer, resell, or use the Services to violate any law, FMCSA regulation, or third-party right. Tampering with ELD devices is strictly prohibited and may be reported to authorities.

7. Compliance Disclaimer

While Truck Pilot's Services are designed to assist with FMCSA compliance, ultimate responsibility for regulatory compliance rests with the motor carrier. Truck Pilot, LLC makes no warranty that use of the Services will guarantee compliance with all applicable laws.

8. Warranty Disclaimer

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limitation of Liability

To the maximum extent permitted by law, Truck Pilot, LLC's aggregate liability for any claim arising out of these Terms or the Services shall not exceed the fees paid by you to Truck Pilot, LLC in the twelve (12) months preceding the claim.

10. Termination

Either party may terminate the agreement upon 30 days' written notice. Truck Pilot, LLC may suspend Services immediately for non-payment, breach, or fraudulent use.

11. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Exclusive jurisdiction lies with the state and federal courts located in Lake County, Illinois.
